Aftermarket Down Pipe Modified Failed Smog Test

I have a 2003 Ford F250 6.0L diesel, with a Banks 3 1/2" downpipe, from the turbo. I was informed by the smog technician that it is considered modified. He failed me. Since this is only modification and has no effect on emissions, is this true? Thank you.

Answer:  

Does the down pipe have an EO (executive order) number? Is it legal for use in California? If not, then yes, the smog technician is correct... the system is considered "modified" and will cause a smog check failure. If the downpipe is California ARB (CARB) certified it should have an EO number. The number is most often printed/etched on the unit. If it is not, it will be printed on documentation pertaining to the unit. If you can prove this particular down pipe is California legal it should not cause your truck to fail the smog test.
