1999 Ford F250 Super Duty Diesel, 7.3L with modified exhaust and performance computer chip

Above described vehicle sold to my wife's daughter & son in-law March 2005. Vehicle was not required to have smog test for transfer of title. At time of sale the exhaust system had been modified IE. 6" pipe replaced the 4" and the catalytic converter had been removed, but saved. Computer chip added to enhance mileage and performance. Smog test is now due, vehicle failed visual inspection. Owner told to bring all equipment up to code. The vehicle wasn't required to have any smog test prior to this year. Not even for owenership transfer. Buyer was aware of changes made to exhaust system and approved of the changes. At this time a smog test is required for registration renewal. What is my responsibility now almost 6 years later.

In our opinion your responsibility is none. At the time your sold your 1999 Ford F250 Super Duty Diesel no smog check requirements existed. During the new owner's ownership of the Ford F250 the smog laws changed, and so the new owner now needs to ensure his/her vehicle is up to smog code. We don't see any responsibility on your part. Should this incident goes sideways you may end up having a judge decide whether you are responsible or not. Again, in our opinion, you have no responsibility to ensure a truck will be up to smog check code 6 years after you've sold it.
