Something does sound funny. We'd recommend two points of contact: A DMV Investigator (to look into the dealership's disciplinary history), and a Bureau of Automotive Repairs investigator to look into the smog station's records which passed the vehicle. Ultimately if you feel you've been cheated in any way, or that the passing smog check results are fraudulent, you can contact the dealership and request to return the vehicle, or deal with the dealership to repair the vehicle properly.
